User Agreement for Processing of Personal Data and Company Policy in This Field
In accordance with this user agreement (hereinafter referred to as the “Agreement”), the activity of the Trading House E ODIN, LLC (hereinafter referred to as the “Administration” or “Company”) ensures protection of the rights and freedoms of the person and citizen when processing his/her personal data, including protection of the rights to a private life, personal and family secrets.
Website «wardrobe-1.com» (hereinafter referred to as the “Website”) is under the jurisdiction of the Russian Federation. The agreement was developed in accordance with the provisions of Federal Law No. 152-ФЗ On Personal Data (hereinafter referred to as the FL On Personal Data) dated 27.07.2006.
When processing the personal data of the data subjects located in the European Union, the provisions of the Regulation (EU) No. 2016/679 of the European Parliament and of the Council of the European Union with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), adopted in Brussels on 27.04.2016 (hereinafter referred to as “the GDPR”), are applicable. In accordance with art. 11 of the GDPR, processing of personal data is carried out in the manner not requiring identification of the relevant person.
The agreement governs the relationship between the company Trading House E ODIN, and you – the end user of the website “wardrobe-1.com”.
Please, carefully read the text of the Agreement. Use of the Website, as well as completion of any of the feedback forms on the Website means your unconditional acceptance of the provisions of this Agreement.
The user hereby expresses his/her unconditional consent to the processing of his/her personal data [contact phone number and email address], which are provided or may be provided in any manner permitted by the laws of the Russian Federation. The consent covers, inter alia, collection, recording, systematization, accumulation, storage, specification, use, extraction, destruction, blocking, depersonalization, removal and transfer, including cross-border transfer. The Consent is granted for 10 (ten) years.
We recommend you to check regularly conditions of the Agreement with respect to modification thereof and/or supplement thereto.
1. General Provisions
1.1. The following terms and definitions are used in this document and in the consequent or associated relations of the Parties:
a. Administration – company Trading House E ODIN, LLC.
b. Content – design elements, text, graphic images, illustrations, videos, scripts, programs, music, sounds and other objects, and their collections, as well as other objects of copyright and (or) related rights.
c. User – an individual having legal personality in accordance with the applicable legislation, acceded to this Agreement in his/her own interest or acting on behalf of and in the interests of the legal entity represented by him/her.
d. Website of the Administration / Website – internet sites using the domain name wardrobe-1.com and its subdomains.
e. Agreement – this agreement as amended and supplemented.
f. Personal data – information that the User provides about himself/herself when completing any form of the data collection on the Website or the data that is transmitted automatically, depending on the settings of the User’s software.
1.2. Other terms and definitions not specified in cl. 1.1 of the Agreement may be used in the Agreement. In this case, such a term is interpreted in accordance with the text of the Agreement or customary business practices.
2. Intellectual Rights
2.1. All content and not just that are objects of exclusive rights of the Administration. All rights to these objects are reserved.
2.2. Except as provided in this Agreement and permitted by the applicable legislation of the Russian Federation, any Content may not been copied (reproduced), revised, distributed, published, downloaded, transferred, sold or otherwise used in whole or in part without prior permission of the right holder.
2.3. You do not have the right to use the brand name, trademarks, domain names and other distinctive marks of the Administration and the Website. The specified rights may be granted solely by the written agreement with the Administration of the Website.
2.4. You are entitled to use the Content, access to which is obtained solely for personal non-commercial use, conditioned upon:
2.4.1. preservation of all authorship marks or other notices of authorship,
2.4.2. preservation of the author's name unchanged,
2.4.3. preservation of the posted information unchanged.
2.5. Unless otherwise expressly stated in the Agreement, nothing can be considered as the transfer of exclusive rights to the Website Content.
3. Information Confidentiality
3.1. As the User of the website “wardrobe-1.com”, you agree with the provision of your data to the Administration for their processing, storage and use for the purpose of consulting, providing information about the products, for the purpose of marketing research conducted by the company, as well as for other purposes specified in the Agreement.
3.2. The Administration does not identify the subject of the personal data and does not check the accuracy of the information provided, assuming that you act in good faith, prudently and make all necessary efforts to keep such information up to date.
3.3. When providing personal data to a third party, the following conditions shall be met:
3.3.1. transfer (granting of access) is performed on the basis of an agreement, the essential condition of which is ensuring of confidentiality of the personal data and security during their processing by the third party;
3.3.2. transfer (granting of access) to the third party is performed according to the applicable legislation of the Russian Federation;
3.3.3. availability of the written consent of the subject of the personal data to transfer to the third party, except as required by the applicable legislation. Cross-border transfer to the territory of foreign countries may be performed in accordance with the provisions of art. 12 of the Federal Law On Personal Data. The cross-border transfer of the personal data to the territory of foreign states not providing adequate protection of the rights of the subjects of the personal data may be performed by the Administration in the following cases: availability of the written consent of the subject of the personal data to the cross-border transfer; provided for in the international agreements of the Russian Federation; provided for in the federal laws;
3.3.4. protection of life, health, other vital interests of the subject of the personal data or other persons when it is impossible to obtain a written consent of the subject of the personal data.
3.4. You are entitled to request and obtain information about the data collected by the Administration in relation to you, to require correction, deletion or restriction of the data processing (right to be forgotten). If you have any objections against processing of your data, you can at any time cancel your consent by e-mail email@example.com or in a written form using the address: 127 Lutsenko St., Belorechensk, 352630, Krasnodar Territory.
4. Additional Provisions
4.1. The Administration does not guarantee that the Website will be available for use around the clock, at a certain point or within a certain period.
4.2. The Administration is not liable to you for differences in the color of the products related to the peculiarities of color rendering and light perception of technical devices.
4.3. Offers and prices on the Website are intended to provide information only and are not a public offer. The manager will provide you with the exact information when you first apply.
4.4. This Agreement applies only to the website “wardrobe-1.com”. The Website does not control and is not responsible for the websites of the third parties which you can visit using the links available on the Website.
4.5. This Agreement may be amended or terminated by the Administration unilaterally without prior notice to the User.
4.6. The new version of the Agreement become effective on the date of its placement on the Website, unless otherwise provided by the new version of the Agreement.
5. The subjects of the personal data located in the European Union, if they believe that the provisions of the GDPR are violated, are entitled to request the Administration to eliminate breaches and (or) to file complaints to the supervisory authorities of the Member States of the European Union.
